The Osun State Government has instituted a legal action against Senator Francis Adenigba Fadahunsi, representing Osun East Senatorial District, seeking urgent court orders to compel security agencies to investigate alleged inciting comments ahead of Saturday’s August 15, 2026 governorship election.

According to court filings, the government’s action followed a video and alleged speech that circulated online after a political gathering held in front of Owa Obokun’s Palace in Ilesha on August 11, 2026.

The state said a transcript and translation of the recording showed the senator allegedly:

1. Directed supporters to attack Accord Party members wherever they were found

2. Made threats against the families of Accord supporters 

3. Ordered that Accord members be chased out of hotels

4. Made derogatory remarks about the party’s yellow caps

5. Stated that the election would not hold* if Accord members resisted APC supporters

The Attorney-General and Commissioner for Justice, Oluwole Jimi-Bada, SAN, said waiting for violence to occur before investigating would defeat the purpose of law enforcement.

“The Applicant believes that waiting until actual violence, deaths, or injuries occur before investigating an alleged public instruction to kill political opponents would amount to a dereliction of duty,” the government stated.

The AG also clarified that the government was not asking the court to determine the senator’s criminal guilt.

“Such a determination would require a proper criminal trial,” he noted.

In the suit marked HOS/M.157/26 filed on Tuesday, August 12, 2026 at the Osogbo Judicial Division, the state is asking the court to order the Inspector-General of Police and the Commissioner of Police, Osun Command to:

1. Investigate the video and determine if the statements constitute criminal offences

2. Preserve, authenticate and conduct forensic examination of the video to confirm if it was altered

3. Provide preventive security for Accord candidates, members and voters before, during and after the election

4. Ensure Accord supporters are not prevented from accessing hotels and other locations during the electoral period

5. Submit a compliance report within 48 hours of any order granted by the court

In a supporting affidavit, Nurudeen Kareem, Special Adviser to Governor Ademola Adeleke on Legal Matters, said Accord members had expressed “reasonable and legitimate concerns regarding their safety and security”ahead of the poll.

The government argued that the police have a statutory responsibility under the Police Act 2020 and the 1999 Constitution to prevent crime and maintain public order.

The legal action comes just 3 days to the Osun governorship election. INEC has cleared 14 political parties for the contest. Incumbent Governor Ademola Adeleke is seeking re-election on the platform of the Accord Party.

Security agencies have been under pressure to ensure a peaceful, credible and violence-free election in the state.
